Montgomery v. Caribe Transport: What the Latest Broker Liability Decision Means for the Trucking Industry (Dakota Group)

A recent court decision in Montgomery v. Caribe Transport provides additional guidance on how freight broker liability may be evaluated when selecting motor carriers. While the ruling does not create new federal regulations, it highlights the growing importance of carrier qualification, documentation, and due diligence throughout the transportation process. For motor carriers and brokers alike, maintaining accurate safety records, monitoring compliance history, and keeping FMCSA registrations current remain essential risk management practices. Strong compliance programs help support business relationships while reducing potential legal exposure.

Most Common DOT/FMCSA Compliance Mistakes New Carriers Make (FMCSA.com)

As the regulatory environment continues to evolve, new carriers face more compliance obligations than ever before. Common mistakes include misunderstanding operating authority requirements, failing to complete annual UCR registration, submitting inaccurate MCS-150 information, neglecting driver qualification files, and overlooking drug and alcohol testing requirements. The article also highlights the growing importance of MOTUS readiness, English language proficiency enforcement, Clearinghouse compliance, and protecting company account access. Establishing strong compliance procedures early helps carriers avoid enforcement actions, operational delays, and unnecessary record corrections.

Trucking Coalition Says 194,000 Non-Domiciled CDLs Affected by Carrier Reforms (FreightWaves)

A new report from the Trucking Association Executives Council outlines significant federal and state enforcement efforts aimed at improving commercial driver qualification standards, strengthening cross-border trucking oversight, and addressing fraudulent licensing practices. According to the report, new federal eligibility requirements could eventually affect more than 194,000 existing non-domiciled CDL holders. The report also highlights increased English language proficiency enforcement, CDL program audits, cabotage enforcement, and expanded efforts to remove unsafe operators while supporting compliant carriers.

DHS-Led Operation Results in 800 Truck Drivers Removed from U.S. Roads (TruckNews)

Operation Highway Shield brought together DHS, ICE, FMCSA, and other law enforcement agencies for a three-day enforcement initiative targeting unsafe commercial vehicle operations. The operation resulted in hundreds of drivers and vehicles being placed out of service, multiple arrests, English language proficiency violations, and the recovery of nearly $1 million in stolen cargo. The operation reflects continued federal attention on commercial vehicle safety, driver qualifications, and regulatory compliance. Motor carriers should ensure drivers remain properly qualified, maintain complete compliance records, and stay current with evolving FMCSA requirements as enforcement activity continues to increase.
